Welcome to JobPilot. By creating an account or using our services, you agree to these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By accessing or using JobPilot ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the Service.

2. Description of Service

JobPilot is a SaaS platform that provides field service contractors with AI-powered customer intake tools, job management dashboards, and email notification services. We are not responsible for the quality of work performed by contractors using our platform.

3. Account Registration

To use the Service, you must:

• Be at least 18 years old and authorized to conduct business
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized account access

You are responsible for all activity that occurs under your account.

4. Subscription and Billing

JobPilot offers a 3-day free trial followed by a subscription at $49/month. By subscribing:

• You authorize us to charge your payment method on a recurring monthly basis
• Subscriptions auto-renew unless cancelled before the next billing date
• You may cancel at any time; access continues through the end of the paid period
• Refunds are not provided for partial billing periods except where required by law

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Collect customer data without lawful basis or proper disclosure
• Send unsolicited communications or spam
• Impersonate any person or entity
• Attempt to gain unauthorized access to our systems
• Use the Service for any unlawful or fraudulent purpose

6. Customer Data and Privacy

When customers submit service requests through your branded intake form, you are the data controller for that customer information. You are responsible for:

• Having a lawful basis to collect and process customer data
• Informing customers how their data will be used
• Complying with applicable privacy laws (CCPA, GDPR, etc.)
• Responding to customer requests regarding their data

7. AI-Generated Content

JobPilot uses AI (GPT-4o-mini) to process service requests and generate responses. AI outputs may occasionally be inaccurate or incomplete. You are responsible for reviewing AI-generated content before acting on it. We do not guarantee the accuracy of AI assessments.

8. Intellectual Property

The Service, including all software, content, and branding, is owned by JobPilot and protected by intellectual property laws. You retain ownership of your business data. You grant us a limited license to process your data to provide the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBPILOT AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE THREE MONTHS PRECEDING THE CLAIM.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Termination

We may suspend or terminate your account if you violate these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases. You may request deletion of your data by contacting us.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice in the Service. Continued use after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law provisions. Disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
